Legal provisions applicable to server rental and colocation

Users must comply with the following Chinese instruments named in the original notice:

Interim Provisions on the Administration of Internet Culture, and other applicable national laws, regulations and administrative rules. Users must not produce, reproduce, publish or distribute harmful information prohibited by law or regulation. Users bear full responsibility for political and legal consequences and economic loss to FUNI arising from business activities or published information that violate these requirements.

Under the Measures for the Administration of Internet Information Services and the Provisions on the Administration of Internet Electronic Bulletin Services, users must retain website access logs, including published content, publication time, Internet addresses (IPs), domain names and related records. These must be supplied when competent national authorities lawfully request them. Users bear all responsibility for failure to retain required records.

Users undertake not to use servers for activities on the Internet prohibited or unwelcome under national laws, regulations or public morality, and not to facilitate others' publication of content inconsistent with national requirements or this agreement, including through URL or banner links. Users acknowledge that FUNI may, using its own prudent judgment, determine whether published content violates this agreement or national requirements. Such activities and information include, without limitation:

Email advertising and spam: sending large quantities of unsolicited or unwanted email or electronic advertising, or email containing harmful information such as reactionary or pornographic content; or promoting, introducing or soliciting business for a server-hosted website through such bulk unsolicited email or advertising.

Information involving state secrets or security; feudal superstition, obscene, pornographic or vulgar content, or incitement to crime; prize betting and gambling games; information violating national ethnic or religious policies; information endangering Internet operations; and information infringing others' lawful rights or otherwise harming social order, public security or public morality.

Users are responsible for the integrity and confidentiality of data stored on their servers and credentials or passwords used to access and administer them. Users bear all losses and consequences caused by loss or disclosure resulting from improper maintenance or failure to maintain confidentiality.
